1st time underage in FL

*excuse me on my english* :-( I am originally from Europe.
On June 5th ..Well I went out with my friends..I was driving I wasn't drinking untill like 1:30am..well then I decided to drink 2beers...and it got me a lil bit..plus I drink antibiotics..So at 2am they decided to go eat..and ask me to take them to Dennys.. So theres 3lanes..I was driving in the middle one..I had no idea where i was driving b/c im from another city..so they just said turn right there..but i didnt have time to turn to another lane..so i just turned straight from the middle lane to parking lot of dennys..then police came..and wrote me a ticket for improper change of lane..and my BAC was 0.088 and 2nd one was 0.084 ..and he took away my license and supsneded for 6monthss and he wrote ELIGIBLE for permit..so I don't even know what that mean..if its DUI ..or they still need to decide..I didnt go to jail.. well I payed my ticket today..I found an attorney..shes asking 2500$ ..and she said worst can happen that they suspend my license for a month..But I am really scared that if i get DUI then i have to pay attorney and DUI ((
If anyone can help me on this what shoul I do..I would really appreciate it... This was my frist time driving drunk..which I wasnt even really drunk..I was able to drive..But i didnt know the way thats why I turned like that...Anywaysss I been driving for like 2 yrs..never had anything like this..or a ticket... Since your underage you automatically lose your license for 6 months if you are found driving with a BAC of .02 or above. You are lucky he didnt charge you with DUI, so I doubt you will be able to get reduced. Under florida statute (322.2616) underage driving with a bac of .02 or above is not a traffic violation, nor can they arrest you. They just take away your license automatically for 6 months, from the day he stopped you. He should of gave you a permit which can be used for 10 days. You will also be forced to take a class. This is an administrative action and since your not being formally charged with a crime, a lawyer wont help you much. Just be thankful he didnt charge you with DUI and suck it up. You may be eligible for a permit to go to school or work, but you would have to check with the court.

Thank you for your response. But the only thing is..when I went to DMHSV they gave me a paper(request) to fill out for a permit..and she said find a lawyer..

I dont understand. Were you or were you not charged with DUI. With my understanding its that it wasnt a DUI thus being that you do not need a lawyer because this is an administrative option, theres no court case because its not a criminal or traffic offense. The permit must be a special license allowing you to drive to school/work and substance abuse classes. He would of arressted you and given you a ticket if it was a DUI.
