I have recently bought a van from a "not so family" family member. I purchased the van for $2,000 about two weeks ago.
I did not sign anything nor do I have the title yet. The day after I purshased it I was driving it when I realized their was something really wrong with the transmission. He had taken to his mechanic to get it fixed about a week later, his expence. The van needed a whole new transmission and when he found that out he was not willing to pay for it. The van sits outside of my house undrivable. I still have not signed any papers or nothing. Can I take him to court to get my money back or a new transmission?

My response:

What is it that you'd like to sign? You seem to be hanging your hat on that point, but the only person that needs to sign anything is him, and he needs to sign the title over to you. That's it.

Insofar as the transmission is concerned, you bought the vehicle without having it inspected first. That's your fault, not his. The vehicle, with all of its problems, are yours.
