When H and R block tried E-filing my taxws this year they were rejected because one of my dependants was claimed by someone else. This lettle boy lived with me for the entire year. I bought his clothes school supplies, paid for school pictures, took him to fun places along with my daughter, attended his parent teacher conferences and his SSt referral meeting. Basically I treated him as if he were my own. Around the first of the year I discovered his father doing drugs in my house so I kicked them out. I did not feel like I had any other choice. Anyway in February he (dad) signed and had notorized a statement saying that they had lived with me the entire year and I had provided them with food, a room, utilities etc etc etc. But apparently his girl friend claimed his son. I don't know how she could seeing as she didn't get out of prison until 8/04 ( I found out in Jan. she was in prison at all) So I mailed in my return along with child care receipts, a letter from his teacher, and a letter from the CPS case worker who had investigated his father earlier in the year and knew they were living with me and that I supported them. My question is what happens next? How long will it take to get my return? :confused:

My response:

As long as it takes the IRS to complete it's investigation. To add insult to injury, if the IRS has already paid the woman a refund, your tax return will be processed, but you won't see any money until next year when the IRS has a chance to withhold her next refund to pay you.

If she's a criminal, and you can locate her Parole Officer, I would suggest that you report this matter.

If the IRS determines that you are owed the refund, they will send it to you, and then pursue the offending party. You will not have to wait for the offending party to cough up the money before they will send it to you.

I did some surfing and located her on the AZ dept of corrections page... She is currently wanted (absconded) and violated her parole, Get this she went down for criminal impersonation, fraud, Extreme DUI and possession of dangerous narcotics. I believe she is still working at the same location but I cannot remember the name. I sent in the page from the web site that I printed out showing her charges and when she served time, with my 1040. My problem is that I don't really have a paper trail of proof that I supported this kid and his father. I don't have access to the school files because I'm not a legal guardian. I did however get a letter from this years teacher stating her started the year in her class and was withdrawn after the Christmas holiday. Last year's teacher is gone. I was hoping they would send me part of my refund this year. Any ideas how I can prove I supported them. His Dad got food stamps a month before I kicked him out but I do not think DES can share his case information. Any ideas? :confused:
