Kansas DUI

What is the name of your state? Kansas - I recieved two DUI with in a 2 hour period. First arrest I blew a .22. I was released to a friend with in an hour. I recieved second DUI 4 blocks from where my car was left. I was held 6 hours for the second DUI. My question is, should they have held me for 6 hours after the first arrest? My lawyer believes that I should have been held the first time? This happened in Overland Park KS. Is there any law that states they have to hold you for any amount of time?

I think it is up to the officer if he feels like he should hold you but since there was a friend there he released you.

I believe they only hold you if you refuse to be tested and/or become uncooperative. Also if there is no way for you to get a ride home before becoming sober. They are allowed to hold you up 2 24 hours.

Okay, I just have to ask, why on earth where you driving again, in the same night, when you already had one DUI? It is not the cops job to hold you until you sober up and grow enough brains not to do it again.
