What is the name of your state? GA
I notified my old apartment complex 30 days before I moved out that I was leaving. Nothing was said before I moved out but now I receive a bill for 2 months rent. I asked where in the contract does it state that you can charge me two months rent and they say it is end the following section of my contract below. Just to recap, I signed a 6 month lease and at 5 months I gave my notice. Then, proceeded to move out at the end of my lease. My lease doesn't include an automatic renewal clause.
Contract Wording:
Renewal / Extension / Holdover
Unless Resident notifies landlord at least 60 days before expiration of this term of this lease agreement of an intention not to renew this lease agreement and does not vacate the premises at the expiration of the term of this lease agreement, then the resident shall be considered as holding over on a month to month basis (the “Holdover Tenancy”) with all terms herein remaining the same of this lease agreement either landlord or resident may terminate the holdover tenancy upon 60 days written notice to the other during the holdover tenancy.
My question is that they seem to say they are charging me because I became a Holdover Tenant. But as I read the first sentence I thought that it didn't apply because of the word "and". I thought this meant that If I stayed in the apartment after my lease was up that I would become a holdover tenant. If I'm in the wrong, I'm in the wrong. I just wanted to here some other people's opinions.
