I worked for the IRS in 2004, entering tax information into the computers. I never expected that I would have this kind of problem with them, as they should be the ones setting the example. I still haven't recieved my 2004 W-2, and I have called them several times about it. Each time, I get a different person on the phone who always giggles when she finds out that the IRS has not sent me my W-2, as if it is some kind of funny joke. I find this to be really unprofessional and frustrating. Each time the person has told me she would put the message through to the appropriate place, but nothing has come out of it.

I don't know what I can do, though, as the IRS is the one that is supposed to enforce this sort of thing.

You can fill out Form 4852, 'Substitue W2'. It's for the situation where an employee cannot/does not get a W2 from the employer. Using can fill in the form using the 2004 last check stub showing year to date withholding? Just fill out the Form 4852 with the numbers from the check stub, and use it just like a W2. Assuming that you still need to file for 2004.

Other than that, all you can do is report it, write a complaint or something. They still do not do much if other employers do not send out W-2's either, based on a past experience that I've had.

You can also go to the nearest local IRS office and ask them to look up your 2004 tax records and print you a transcript, which you can use to file your taxes.
