Question for you guy's.I got a dui when I was 17 about 8 years ago and
got my license back.and now I am 26 and got another a few day's ago.I was
in the testing process for the chp,I passed written,and QAP.It took a lot
to go through all that.Now I don't know what to do, I really messed up.Will
they hold my first against me and what are the consiquences going to be
I have gotten a lawyer my driving record is really clean other than those
I have a awesome job, but have to drive about 30 min to get to work
are they going to let me have a restricted license.

Do you think you should be a CHP officer? Wow, I don't want you responding to me on the freeway.
You kind of need a licence to drive one of those CHP cars.

Kiss the CHP goodbye, and get healthy and learn from it. It is not the end, but CHP is out of the question.

The lookback period for prior DUIs is now 10 years after January 1st ... not good for you.

And, as a background investigator in CA myself, I can guarantee that your application for the CHP will be deep-sixed if you are convicted. It will be in great peril even if you manage to get out of the charge because they will still read the report. A DUI (especially a second one) will go a long way to deomnstrating your maturity level, and I can't think of an agency that would hire you full time with that on your record.

The one 8 years ago might have been forgiven for work with the CHP. But the new one? Nope.

It's possible that if you wait a few years, do some really cool and mature stuff between now and then (go to college, get a degree, hold down a single job with glowing reviews), in three or four years a police or sheriff's agency MAY consider your application.

But, I think the CHP is pretty much out.

I'm not too sure ... likely a suspension for a year, fines, counseling, court probation, and no jail time. But, up to a year is possible.

I would suggest you consult an attorney that specializes in DUI and see what kind of a deal he can arrange.

Response from a 2 time DUI offender:


Usually, 2nd DUI's serve a state mandatory minimum unless your attorney's a genius..AND.. he/she is willing to negotiate you off the hook. Don't count on it. It's extremely politically incorrect for attorneys to get DUI offenders off the hook. That'll be jail (maybe work release), community service, work crew or a combination. Maybe since it's been 8 years since your last one, they'll be more flexible. The problem you've got is the presumtion that you've been continuing to drive DUI since your last one. You just finally got caught.

Unless CA is weird, you'll serve concurrent mandatory DMV and court ordered license suspensions. And there will be a waiting period before you can apply for a restricted license. And they're pretty hefty for a second one. I guess you're only hope stems around whether you'll qualify for CA version of diversion. Maybe because of the time between DUI's they'll let you enter the CA diversion program. That's where your attorney comes in. But I think in most states, if you have a prior, you don't qualify for diversion.

I'd be amazed if he was actually sentenced to serve any time. I don't recall ever seeing a 2nd time offender in CA do any jail time. It's always possible, but usually doesn't seem to happen. The third time seems to be the charm.
