I put in a guilty plea for a dui that landed me in diversion. 6 months later now, and I just got my second. I haven't started treatment yet...I am an engineer at a leading aerospace company and I'm concerned for my job. What is the jail time associated with a second dui? Is there anything I may be able to ask for (drug court, extensive treatment, comp. work??) in hopes of avoiding a jail sentence? I really want to start treatment and get all of this in order but I am sincerely concerned for my employment if I must serve.

You can start with what state you are in, and what statute you have been charged with violating.

In every state I am familiar with, diversion programs are available for first offenses only.

By violating the terms of your diversion program by being arrested and charged with another DUI, the guilty plea on your first offense can be entered, leaving you with a criminal record. Your most recent DUI will be charged as a second offense.

Your state name is needed to see what the penalties are but it seems clear you need an attorney in your area working for you. It also appears you have good reason to worry about your job.

I can tell you most judges in any state are going to take a second DUI while on a diversion for the first rather sternly. You're going to have that first DUI conviction entered (or at least go to trial on it depending oin the state) and get hit very hardly on the sanctions for both that and the new one.,

You need a good lawyer big time.

That we can tell you without knowing what state it is.

In addition, you need to stop being stupid. You are right to be concerned about your current job, and you should be concerned about any future employment as well.

You need to get help - obviously you have a drinking problem.

*Why* haven't you started treatment yet?

Clearly you have a problem - apparently you *can't* just stop any time you want.
