2nd oui offense

What is the name of your state (only U.S. law)? I am in MA. My question is my boyfriend is currently in jail. He was cause driving on a suspended license with 2 oui's pending. The judge revoked his bail until both oui cases were settled. The law in ma is a 60 mandatory jail sentence for operating a vehicle on a suspended. However the DA is not charging him with that sentence. Will he have to serve the 60 days for that.

Yes. And likely more time upon disposition of his oui's. He really needs a lawyer immediately.

Thank you.... He has an attorney I have already retained him. The attorney said he can get him probabtion for the ouis. My concern is for the 60 days. The attorney told me the Da was not charging him with the 60 day mandatory sentence as of yet.
