My question is as 2nd owners of a home, do we have any legal rights to request the builder to cover repair cost associated with damages that have occured due to faulty construction and design. The details are as follows: The home we own is 13 years old. We are the 2nd owners and purchased the house 7 years ago. Over the past 3 months we have discovered structual problems that are associated with the design of the house and the quality of the construction. The first problem is the chimney sleeve/liner. Very other year we have had our chimney cleaned but this year the chimney cleaning service we used inspected the chimney with a video camera and discovered that the liner was broken. It appeared that a section was damaged during construction and the construction workers simply took bits of brick and mortar and patched the liner resulting in a constricted opening in a portion of the chimney. The 2nd problem is water damage on the ceiling of a first floor room due to the brick window sill on a second floor window not being angled to prevent water from accumulating on the sill. Also, this window sill rests on the roof instead of having the 5" clearance as requird by code. This design allows water to run off the roof and onto the window sill resulting in excessive water to accumulate on the window sill. This has resulted in the wooden portion of the window sill to rot. The cost for repair on these 2 items (chimney and water damage) is $10k.
