3 1/2 months into 1 year lease and we want to sell

What is the name of your state? California

Can we break the lease with our tenants so that we can sell the property? If so, what is the process? Will an agreement with them for them to move out be legally binding?

you can cancel their lease, but only if they agree. don't be surprised if they insist on some sort of compensation, i.e. $$$$.

if they don't want to leave, you can't legally force them to.

if you sell the house with them still in it, the new owner must honor their lease. you will also need to transfer the security deposit to the new owners in accordance with your state's laws.

That's good to know. We were planning on offering them compensation. We know we can't force them out and we wanted to make sure they couldn't come back and sue us even after making an agreement with them that they would move out.

Who's Liable?

You don't have to tell them that you are selling the house either... They will become the responsibility of the new owners...
