I am writing for my cousin in Riverside county. She recently moved into a home that a childhood friend of ours and her husband own. She has section 8 and they never signed a lease agreement. Everything was fine until our friend and her husband had marital problems and then the husband started harrassing her and trying to make her leave. On saturday he left a three day notice to leave and is asking for rent. He has never served a 30 day notice. They have never agreed on an amount and apparently in the letter it states something about a lease and how she has never paid. She is also on disability and recently took custody of our nieces small children, one of which has breathing difficulties and is not even a year and a half old.
What can she do? I checked some state laws which says they can't evict out of retaliation.
I am trying to help her by typing up a letter, but am not sure what all to include.

Your story makes no sense....Section 8 will NOT ALLOW HER TO MOVE IN without a signed agreement AND an inspection of the property.

Ask her how she got access to the property?
Ask her who did the housing inspection?
Ask her how much rent the PHA has authorized for her rent?
 
ok first, it's not my story, it's hers...I just simply posted what she told me. I am not and have never been on Section 8 so I don't understand the inspections and all of the terms.

Why on earth would your cousin "take custody" of small children, one of whom has medical problems, when she's disabled and can't take care of herself?
 
Maybe because she didn't want to see them go with strangers and she knows that GOD would never give her more than she can handle....
but the main concern here was the 3 day notice not her kind and loving heart

More importantly, the STATE shouldn't allow her to take custody of children she can't support. God will provide for the kids just as well as he/she will provide for her, she doesn't need to be a martyr.

I'm gonna guess that her family was not charging her rent and so not getting any payments from section 8, so there is no oversight on the place or the owner.
