Me and my Son fell into an open ditch on leased farmland on April 2/00.Insurance co. has been properly notified of our intent to hold them and their client liable.They hired a Independent Adjuster as they are in Fresno Ca. and we are in the Bakersfield Ca. area and him nor us can get any response one way or the other (or of anykind) and it has been 3 months.Considerable injury,s were sustained including a broken leg.Is this Legal for them not to respond in this length of time.And what can i do.

My response:

You can hire an attorney to sue for "Premises Liability." If you're holding your breath waiting for an insurance company to contact you, you should be dead by now. You both have one year from the date of the incident to file your lawsuit.

As a general principle an insurance co has no obligation to reply to a demand or a notice from a victim. It would be a good idea to consult with an experienced injury attorney in your area.
