I live in Oklahoma. Our rent was due 03-01-2001. We did not pay it. We were suppose to go to court 03-21-2001. We did not. When we moved in I paid first and last months rent plus deposit. Today a note is posted we have 48 hours to get out and then the locks will be changed. Can they do this? The $ paid when we moved in should cover us until 03-31-2001 shouldn't it?? Don't they have to give us a 30 day eviction notice?? This first thing we received regarding the eviction process was probably around the 10th of march.Please answer quickly I have 3 children and NO PLACE to go 48 hrs from now!!!

I'm glad you saw this as ha,ha....Let's see you ha,ha when you're going from motel to motel trying to find one you can afford while your 8 yr old son is crying and asking why can't we just get somewhere I'm tired and HA, HA again when you do finally find one cheap enough and your 2 yr old daughter won't leave your side the whole night and keeps pointing around the room and saying I scared, I scared. And after thier asleep Try to ha,ha while thinking about the person you lost everything for, that after one night with no home took his son and went to his parents home and keep laughing while you try to figure out how to get the antibiotics your 2 yr was taking that's still in the apartment refrigerater that the manager and police officer couldn't give you a minute to grab during the eviction or how to replace the only coat your 8 yr old son owned that's in the apartment living room still. And I haven't even mentioned my own blood pressure medicine on top of the frige and that I'm 3 months pregnant. Believe me I'm trying real hard to HA,HA between my tears and my childrens tears but somehow Laughter is NOT coming easily. If you can ha,ha after coping with all of this then you're alot stronger person than I am. Thanks for the advice.

OH gee purplemist LISTEN TO YOURSELF...

First you have 3 kids with fathers who cant help you out in times of need....or dont you have any family grandparents aunts, uncles?

What about your family values?

Then to make matters worse you dont pay the rent, DONT show up in court AND youre 3 months pregnant

talk about total irresponsibility.....

If you want my sympathy GIVE YOUR CHILDREN UP FOR ADOPTION, THEY DONT DESERVE THIS KRAPOLA FROM YOU...AND THE NON EXISTANT FATHERS!!!!!!!!!

Advice OR Judgement??????!?!?!??!?!?!?!?!?

First of all I came here for advice not to be judged. 2nd-let me clear up one small issue, that doesn't even really matter but..... I have only two children. When I said 3 children I was encluding my boyfriends son. 3rd....Do you even have any eduction In law??? Do you ever actually give honest helpful legal advice or do just wait for someone like me that you can pounce upon to somehow make your hollier than thou exsistance seem like more than it obvioulsly is???? And in my childrens father's defense he pays $800.00 a month in child support, but after a car payment, car insurance, and food for the month that just doesn't cover a whole lot more. That still leaves any dr visits, any school projects, clothing, and the never ending need for toys. And as far as my family, yes I have family. I have a mother and an aunt. My father died in January of liver cancer....So my mother has ALL of the medical bills to worry about since the insurance co canceled his insurance the day he went to schedule the test that would have told us, (perhaps before he only had 3 mths to live) that he had the cancer. So my aunt and her teenage daughter moved in with my mother to help her out. So I really didn't feel like now would be the best time to have my hand held out. As far as not paying my rent....I thought since I had paid 1st & last months rent PLUS a deposit when I first moved in that the rent would be covered until April 1, 2001. By which time I had planned to try to be out anyway because we were not happy living there and was hoping to find a house. And has far as giving my children up for adoption!??!?!?! WHO THE HELL DO YOU THINK YOU ARE?????? Obviously not someone I would want for my mother.....THings get a little tough and you ask family for money and give your children up for adoption????? Are you a mother?????? Anyway.....at least now I don't feel so bad about my life....I have problems yes, but At least I know when someone asks for help or advice and it's in my ability to give it to them, I do. And isn't that what it's all really about when we're through here....When "THE DAY" comes...I think I'll be judged for the kind of person I am more so than did I pay my rent every month for all of my life and if I knew YOU SHOULD ALWAYS SHOW UP FOR A COURT DATE....Again....Thanks for the advice.

Just to answer some of your questions about "mary":

No, I don't think Mary Hartman (aka dj, aka dj1) has any education of any kind. Nonetheless, he doesn't seem to mind looking like a jackass.

Answer is yes, he does one of those two options. He occasionally gives legal advice, but it is rarely the right thing. He seems to have gotten whatever he knows from reading about it, rather than by actually living it, but then lots of attorneys are that way too. He is unable to grasp that there is a world outside of New York, and that other sovereign states have a right to make laws their own way. Sometimes, their laws are even better than New York's, but this guy cannot accept it. He has a need to put other people down probably as a way of making himself feel superior. I think that he is genuinely mentally ill.

3. I once told a woman who was using the excuse that her children were suffering as a way of demanding things from her landlord, and I told her that keeping her children from suffering was her responsibility to provide for her children, and that she should leave if her children were suffering. Since then, dj has been copying my response, but as usual, he doesn't get the details right. He doesn't know where the responsibility starts and ends, and he hasn't any idea what parents owe to their children. It is so obvious that he doesn't have children of his own, or has ever had any responsibility in life equal to that challenge.

4. He isn't able to tell you simply that you cannot allocate security deposit to rent without the landlord's consent. In fact, he has used the same argument that you did, to advise other people, telling them to demand their rights, sue, go to the police and have them arrested, etc. He is all talk and no action, and I don't think that he has any actual experience to draw on.

5. He has an incredible deep-seated resentment of landlords. He has absolutely no understanding of how the law splits up the responsibilites between landlord and tenant. To an educated man, it is clear that he has had one or more experiences that have hurt him, and he puts on this facade and exhorts other people to take such extreme actions against their landlord (which are actually to their own detriment) as a way of getting back at whoever hurt him.

6. Don't forget that child support is not meant to be used for car payments and car insurance.

Times are tough, life is hard, since you father died cant you live with your mom?

Why was the insurance cancelled? Maybe you should have gotten a lawyer back then to make sure daddy had insurance.

And YES your last months rent should have covered March's rent.....But you didnt show up for court!

This is American you have a right to defend your self in a court of law, AND NO ONE can take that away from you....

Except YOU.....when you dont show up.....thats why this happened to you. You had rights but you THREW them away!

OH PS why are you pregnant with no money?

- This is what is clearly stated in Bold Red letters as I sit here typing this reply. As someone who doesn't always have my life on track and together, I must stick up for the emotional well being of all people, and I think such a lack of sensitivity is bound to come back to haunt us in our most desperate time of need for anothers help,if we ourselves are sharing such a low level of compassion to others.

Please remember this when speaking in future responses. It might just mean a whole lot to someone who needs it, and in turn your response might be a little more meaningful too.

Where does someone ever get the idea that showing up for court is NOT necessary?

how do people in this country, have so little knowledge about what our great country is all about?

Why is it that people get preganant when the are broke, and about to get evicted?

Shouldnt this person be held accountable for her lack of caring about being responsible?

Why isnt she getting an abortion? Why isnt the FATHER kicking in money to keep from this happening?

IT APPALLS me to see so many Americans who are so clueless!

Mary Hartman-First of all I did not KNOWINGLY, throw away my rights. I guess it was willingly in a way because I CHOSE not to go to court. But had I KNOWN they could evict me in 3 days from the court date and by going to court I might have prevented this, I would have gone. It's over now and I can't take my LACK of action back. The only area I feel you can find fault in my choices is in my ignorance of the law, but this doesn't make anyone a bad person. Anyway, it's time to move on...Besides look on the bright side IF there were not screw-ups like myself in this world who would you look down upon from your throne?????


LL & Itsme - I really do appreciate your responses. I'm unuse to such rude people like MARY HARTMAN, it had pretty much always been my experience that if you treated people kindly they would treat you in the same manner. But between the four people that came into my apartment to evict me and my good friend MARY HARTMAN, I discovered sometimes it just doesn't work like. Oh well, what comes around and goes around. By the way....before I get attacked by poeple who do the evicting....I KNOW they had a job to do. I really do know this, but what or whom would have been hurt if they had given me another 30 to 45 minutes to finish getting my things out of the apartment???? I could understand if I HAD NOT been trying to comply with the judgement. When I rented the storage room the ad in the phone book said 24 hour 7 days a week access. So when my boyfriend got off of work at 2:00 am (he's a machinest and works nights) we began loading what myself and two friends had packed but when he took a load to storage our code would not open the gate...Anyway...I discovered the next morning that the hours are actually 5:00 am to midnight UNLESS you REQUEST later hours. Well...that cost us alot of time...So when they came to evict us it didn't matter that 99% of it was packed and 90% of it had already been removed. I just dont know how they stood there and watched our remorse about leaving our things behind as well as felt no guilt when I pointed out that my son didn't have a coat and a couple of other items I remarked on and yes at this point I was not so polite. From a legal point....Would it have been such a big deal to give us a small amount of time to finish???Hell, I would have even been willing just to put it all outside on the sidewalk and load it from there. Anyway......I just know I could not do their jobs and sleep easily at night. Thanks again... I guess I better get off of here and go see what my kids are up to.

I am NOT looking down at you, just making you realize that we are AMERICANS, and we have certain rights granted to us and we are the luckiest people in the world to have them.

So I am really APALLED at the vast majority of posters who have no clue about American Civics.

Our new fangled feel good education system sucksss and everyday it is proven right here...

YOU would still be in your apartment today, if someone taught you about the country you live in....AMERICA!

So dont let your kids have such a poor education, as you do, about what this country stands for.......please
