30 Day Eviction

We have been renting a one family dwelling for about six years. Year and a half ago it was sold to an investor. At the time we told him we would like to purchase. After numerous inquiries the owner finally advised us what he wanted for the house and offered to carry the paper at 11% interest. I told him I definately wanted to buy but wanted to check into other financing. He said no problem let him know. Shortly thereafter he raised our rent $100.00.

The problem at hand: Two young men showed up asking us when we could move? Apparently they have purchased the property. We have never been advised of this. They said the owner would be calling us. He did not.

Four days later (4/18/00) the new owner delivers a 30 day eviction notice stating we must vacate by May 31, 2000. (Note also states this is when our next rent is payable.) At the same time he gives us a handwritten note that states if we pay rent he will give us an additional 30 days.

On May 1, 2000, 2:30pm, the new owner shows up again asking for our rent. I told him I was not paying rent until I had spoke to my attorney. He already had a 5 day evicition notice in his hand which he gives me. This notice states late on rent, we have five days to pay. So on the third I paid.

I do not have a problem with moving except for the fact I have a home day care. It takes about 90 days to become certified which is non-transferrable. I have tried to reason with him for extra time but he says his lease is up in his apartment, he wants the house. Besides personal belongings I have playground equipment ie: trampoline, 4 swingsets, jungle gym, two play houses. I have already found a house and am waiting for loan approval.

My questions are

1. Does he have to give a business owner more time?

2. Did the 5 day notice to pay rent override the 30 day notice to vacate?

3. Can I file a petition with the court requesting additonal time before he tries to throw me out?

4. How long will it take for him to throw me out.

5. Doesn't the landlord have to notify me and is there anything I can do since he didn't?

6. Also, the new owners keep driving by and more often than not stopping to see how much we have packed up and asking if we will be out by the end of the month. Their note gave us an addl 30 days if rent paid which should give us to the end of June. Could this be considered harrassment? How do I make him leave us alone before my sister and I have nervous breakdowns from the stress?
