I live in Nassau county in NY. I rented an apartment that I am now told by the police is illegal. I have had problems with my landlord refusing to make repairs. We went to court, and in a mediation agreement, the landlord agreed to make all repairs by Dec 1st. He has not made a single repair. We spoke to him about it and he said if we dont like it we should move. He refuses to keep his end of the agreement.

I filed a motion to vacate the agreement, and now my landlord served us with a 30 day notice terminating our monthly agreement. It says he wants us out by January 15th. I have a 7 month old daughter and no money to move. The notice states that he will sue me for back rent if we are not out by then.

I have been told by an attorney on this site not to pay him, that a landlord can not by law recieve rent on an illegal apartment.

What should I do? and....I have tried to look for the NYS statute that says that he cannot collect the rent...can you tell me what # statute it is? I do not want to be put into the street with my baby.
