i gave my current roommate a 30 day notice. she said that she's not moving out and needs at least 3 months. i am the one leasing the apt. i've been there for almost 2 years. she's been there 3 months. we never had written/verbal agreement. nothing was ever signed. she also said that if i got legal about it that she would claim squatters rights. what is squatters rights? does she have the right to stay in my apt? do i have to let her stay 3 months? does she have to still pay rent? thank you.

You need to list what state you are in, in order to get an accurate answer.

Usually a 30 day notice to vacate (in writing) is sufficient & starts from the 1st day of the following month. (i.e. if you notified her 11/12 she had 30 days to vacate she would have until the end of December). Squatters rights do not apply in this situation. She does have to pay rent up until she moves out.

Trying to go through the legal system to get her out will be a pain, and she would probably end up getting to stay the extra 3 months she wants! It would be easier to get something in writing from her on when she plans to move out & make sure she pays her rent up to date.
