Tenant gave 30day notice on 5/6 stating will be out by 6/6 requesting to pay prorated amount for June. I notified them I accept notice but full month rent is still due on 1st of June. Renter replied requesting to stay until end of June since will be held responsible for June rent. Actions already taken to try to get new renters after 6/7. Renter would still need to pay full month of June and to be out by 6/6 is that correct? Also renter states forfiets Security deposit for damages and withdrawing and giving ultimatum. Please help asap.

My response:

You can't have your cake and eat it too. Either take the full rent for June, and the renter stays, or he pays prorated amount, and you re-rent on June 7, 2000. You can't have both. If the place is as clean and kept in shape, except for normal wear and tear, you must return the security / cleaning deposit. Go on a "tour" of the premises prior to tenant vacating. Make a list of what was broken, uncleaned, or ruined, beyond normal wear and tear.
