My 16year old son Brandon was at public high school today, when another student Jose (18yrs) approached my son wanting to start a fight, my son said no I don't want to fight, and then Jose punched Brandon in the face, Brandon said that they then locked up. Brandon ever hit the other student. The police were then called and Brandon and Jose both got charged with 3rd degee assault.

What should I do from here...does Brandon need a lawyer...

you should probably get one. if your child did not hit the other child, was there a witness stating otherwise? was the other child bruised? injured in any way?
