What is the name of your state (only U.S. law)? NY
My parents bought a two family house with an Aunt & Uncle. There are four names on the title. After years of being together, three of them want the fourth gone ... move out .... leave.

I've suggested that the 3 buy out the 4th - they say if the forth party won't sell, they are stuck.

Is there any legal action that can be taken to have this person bought out ?

You'll need a lawyer to file a partition. It's possible that the duplex can actually be partitioned into two properties (which would solve half the problem). If not physically partionable, then the property as a whole would be sold and the proceeds divided.

Is there any chance of sitting down and explaining to party number 4 that if the other 3 file for a partition suit that they could not stop it and it would have fewer hard feelings if they would consent to be bought out at a fair price? If that person still refuses to sell then no choice but to see a real estate atty.
