Hi, I live in Mississippi. I have been married for 20 years. My husband and I have been in counseling but it hasn't helped. At the end of April, he asked me to move out. I moved about 2 miles away to a one bedroom apartment. We BOTH signed the lease, something I insisted on. He has physical custody of both our children, ages 14 and 10. I don't see our 14 year old daughter because she hates me for various reasons, but my 10 year old son adores me and vice versa. I do not want custody of my daughter, nor would she want to live with me, but I do want custody of my son. Here are my main questions: since my husband asked me to leave, and signed the lease on my apartment, he cannot claim I abandoned the family, can he? Also, he makes about 2 1/2 times what I do, can I get support? He has a 401 K plan at his job, am I entitled to any of that money? I hope I don't sound greedy, but this man married a lovly 20 year old girl and used her up and kicked out a 40 year old woman so he could get a younger model. He owes me.
