What is the name of your state? mass

My employer has a 401K joint contribution plan I put in and they put in. But for some 10 months in 2002 the employer was taking the employee contributions from my pay check but not crediting them to my 401K plan. After a lot of letters and time, I now have my money back and a new plan in place. AS the market did so bad in 2002 I am actually better off. They have contacted the dept. of labor (so they say) and are at the minute waiting for the all clear from them that all is well.

But I never did get an apology and my company just keep blaming the pension adminitrators. They were in financial difficulty at the time! Do I have a case to complain about?
