401k Violation

It has come to my attention that my employer has not been forwarding my contribution to my 401k in a timely manner. They have not made a deposit to my account since the end of March of this year. I realize that by doing so they are violating ERISA law.

1) what is my best approach? Do I talk to them and bring it up asking for an explanation and giving them a chance to correct the matter? Do I send them a certified letter to be sure all correspondance is in writing? Is there any benefit to immediately retaining an attorney? Since they've held my money, am I entitled to any interest?

2) I've read the time requirements for when the employer has to move the employee's money into the fund. Is there any such restriction on when the employer must move matching funds?
If it matters, I'm in NC.

talk to the 401k administrator. ask for an accounting and all accrued but not deposited interest should be deposited into your adccount with the original amount owed to you.
