Subject A. has custody of grandchildren. subjects B parents file false cps charges against A. to try and get children back. Children removed from B. because of abuse and neglect but not by CPS but due to court stipulation by the Mother which was going to lose them anyway. Subject B. files false CPS charges against A.
CPS substaniates abuse due to lies and coaching of five year old with behavior problems, poor investigation. Children still were left with subject A. It was subject B attempt to get children back, but it failed. CPS worker types up a letter to give to subject B father taking information from his offical report which is a crime in california and addresses it to whom it may concern, the letter was used in court and shown to various people by subject B.
Does A. have case for violation of civil rights for invasion of privacy under 42 usc 1983. CPS worker is a county employee.
Subject A. filed suit : Defamation, negligence, negligent infliction of emotion distress, invasion of privacy constitutional(State)
