My response:
It would be a breach of the contract / lease for you NOT to pay it. You had 45 days to give notice, and it's not their fault that you miscalculated. Neither party, in all likelihood, would go to SM Court over this; however, if you don't pay, expect a black mark on your credit rating. A new landlord might think twice about renting to you in the future.
