50/50 custody

What is the name of your state? CA

I have 50/50 court ordered child custody. My ex enrolled my son in a full time daycare in San Leandro and is now telling me I have to take him there or he gets kicked out. She proceeds to say that I can only have him every other weekend. I live in San Jose which is about an hour away. I have had my son on my court appointed times since the court order and more because sometimes the mother wouldn't want him back on her time. Do I have to take him to that daycare when its so far away from where I live and I don't have a vehicle?

No, you can make your own daycare arrangements on your own time. However, you may run into the same problem that she has.

You do realize that once your son starts regular school that 50/50 is no longer going to work, unless one of you moves closer to the other one?

No you do not. 50/50 means you BOTH have to confer/agree on schools, medical, legal decisions. ie; You must agree on a daycare, or both provide your own on your own time.

The issue may be that the daycare requires full tuition payment regardless of whether the child goes there 1/2 or full time...but, then again, that's not your issue since You didn't agree to enroll the child there.
