504 Plan dismissal, no testing

Hi, I'm in Rutland, VT and I was wondering what kind of action could be taken toward a school that refused a parents request for disability testing-ADD, Autism, etc-despite obvious attention and learning problems listed by teachers, and dropped the student from the 504 plan in their senior year.
I just helped my girlfriend pick up her transcriptions and documents from her old high school to be used in facilitating some form of disability compensation, and we've found that, not only did the school drop her from her 504 plan her last year, but the school also refused to test for disabilities when her parents demanded they do so. This has consequently reduced the amount of learning she was able to accomplish during her time in the school and has affected her life ever since, having problems with math and reading due to inattention to her disabilities by the school and teachers.

It sounds like this student is no longer in that school and has graduated. If that is the case, she has probably lost her opportunity to take any action. The time to do this was before she graduated. Please also realize that even though the schools certainly can test students, that doesn't mean that the parents could not also have obtained their own testing by a private, licensed professional. Thousands of parents do so every year. After all, the school testing is free, and the parents will get exactly what they pay for. If the child missed out on disability accommodations and the opportunity to do better in school simply because the parents couldn't get free school testing, but wouldn't pay for private testing, that is unfortunate. The private testing is often brought to the schools by many parents every year, and the schools use the information from that testing to provide 504 or IDEA accommodations.This could have been done. However, this student can still get the same thing done if she is in college, and in fact, many colleges offer such testing and it far exceeds the quality of the high school testing. And her parents are still able to pay for private testing, regardless of whether or not she is in college.

There is nothing YOU can do since you are not part of the case.

What did the parents do when she was dropped? Request testing? Why did they say they would or would not do it?

I hope you are not trying to say you want to sue the school cuz GF can't read really well..... don't play the victim here.

The problem is that she was removed from the 504 plan and there was no notification and this is the first we've heard of it. The school's been known to pass the buck in situations such as this. I would just want to bring attention to it so other's wouldn't suffer the same fate.
