What is the name of your state (only U.S. law)? IL

Our company filed BK in December 2009. On March 11 they sent an e-mail stating the 401k was terminated and funds would disperse upon a favorable letter of determination. We were told it would be a few weeks, then we were told that it would be the beginning of the 4th quarter. Some employees have done some research and found what they feel are questionable issues. The first that the company should have given employees at least 10 days but not more than 30 that the plan would be terminated. Is this the case and if so what action should be taken by employees? Second, they have spoken with the IRS to learn the status of the letter. Upon furnishing the info. to the IRS the EIN, plan number, address, are all verified correct, but the name of the Plan is not what the we have, and the IRS will not disclose the info. to them. We feel that there is something seriously wrong. When you ask the H.R. dept. we receive no response at all. How and where do we further research?

Other than the timing of the disbursement, I'm not sure why the concern. Often times the "official" name of a plan is not what you know it as.

However if you feel you have legitimate concerns about where the money is, you would be better served contacting the Department of Labor as they have more direct oversight and enforcement ability over these sorts of matters than the IRS does.
