A well accredited attorney will be taking my case. Thanks! Maybe I didnt explain myself the way I should have please forgive me but there were 3 children involved 1 got punished to the maximum and you're right it is up to me as the parent to see that yes my child did something that was wrong and the 3 day suspension was adequate and not at all disputing that but, the expulsion no way this school is predominately 99.5 Hispanic and is so used to the stereotype of Hispanics in the community and think all are the same type dumb and naive and dont care about thier kids. Well, I am about to show them they picked the wrong one to mess with! The school has rules to follow as well in order to use discretionary discipline.

My son was in a class room setting and the reading instructor turns around and she sees my son touching the little girl next to him in the lower stomach area and so she LEAVES to go get the teacher not stopping what she sees....gets teacher and comes back and the kids both jumped when they saw the teacher. My son was suspended for 3 days and the next day the parents of the girl filed a police report and then the school had my son kicked out of the school and will have to attend 90 day alternative (expulsion). The Vprinciple said it was merely curiosity and the 3 days is all we can do-they are trying to cover their self they made a judgement call and then since the parents went to police after the VP told my sons information of his suspension they were still mad and stated " that;s all he got?" Please help my son is 6 years old my son was not the aggressor another little boy told my son what to do and my son did it.....not because he is this child predator of some sort.
All very interesting EXCUSES, 'spin' and denial of the FACTS.
The bottom line is... your son did the contact. The school then took the action they felt appropriate.
Also, your post isn't clear on what you claim the school was "trying to cover their self" about. The school may have over-reacted (depending on ALL the facts), but I don't see any 'cover-up'.... just the opposite.

I think the "cover-up" refers to the reading instructor leaving the room to get the teacher and not simply stopping the behavior. I suspect it was done so as to have a second adult witness.

I agree in your thinking, but simply do NOT see it as a cover-up in any way. I agree as to the 'witness', but also that it gave the teacher a few seconds to consider the situation rather than just panic and yell out "Johnny, get your hands off of Sally" in the classroom, and the possible embarassment to poor little angelic 'Johnny'!!.

This is the worst kind of post on this forum. There is simply no correct answer that 'Momma Bear' won't attack. Wanna bet that this thread is going to quickly become the "My child was done wrong!" scenario.... with lots of emotions, ranting and raving, and the LEGAL issues quickly being disregarded???
A start of the 'spin' is in the last sentence of the OP:
"Please help my son is 6 years old my son was not the aggressor another little boy told my son what to do and my son did it.....not because he is this child predator of some sort."
The writer is already trying to find someone else to blame for the conduct of HER son!! What if this had been a knife or gun brought by the other student and her son used it?? Would that make him less accountable??? Of course not.
