What is the name of your state? Indiana

Grand daughter was at a city park, watching a softball game with her family. She was climbing on the bleachers, fell and broke her arm..There is no railing or other safety device along this top area of the bleachers.

She has had one recent operation to get the arm's bone in place, but it keeps cooming loose from the elbow socket. She is now being sent to Indy to a specialist for further operations, in an attempt to keep bone and elbow together.

Yes they have medical a 80/20 split, but so far the 20% is growing and the girl has entered a state of depression, not to mention her pain. Can anything be done??

When a guy gets bashed like this:

"Where were her parents when she was climbing on the bleachers like that????? Her parents should be much more responsible. You want to sue becuase your son/duaghter wasnt reponsible. get over it."

I wouldn't hang around either. Shameful.

and what the hell did YOU do to give this poster advice?

NOTHING.

Listen jerk, there is a reason these questions are asked. Unless the park told the little girl to play on an apparatus that is constructed for sitting, or otherwise accepted responsibility that the PARENTS, as legal guardians assumed, then the park has no responsibility in this matter.

keep your comments to yourself and try to learn to read a law book.

Well, damn. Imagine that!

She has had one recent operation to get the arm's bone in place, but it keeps cooming loose from the elbow socket. She is now being sent to Indy to a specialist for further operations, in an attempt to keep bone and elbow together.
Understandable.

Of course.

Can anything be done? ?
Help her learn this is what happens when children climb on tall objects that lack protective barriers. Help her parents learn this is what happens when parents take their eyes off of their children. Help pay for the medical bills.

EC, the dear Abby version.

Why is it unreasonable to expect parents to supervise their kids?

You have been given correct legal responses, there is probably no cause of action. What everyone is having a problem with, is the failure of you and/or the parents to take responsibility for the child's injury while shifting it to someone else.

sue the parents for not watching her, also sue your self for not raising your kid to understand that when they have kids they need to watch them
