My Ex Fiance is threatning to take me to small claims court for material items he bought me during the relationship, ex, clothes, cell phone, gifts, etc.. He lives in Fla, I Live in MI, He was my sole financila supporter I did not work he knew this, he gave me credit cards in my name but him being sloely responsible for the bill, we had no written agreement for me to repay him , he didnt have a problem doing anything for me, until I left him, He says I abused him financially and now he wants reimburesd. He says I told him I would repay him, he claims to have witness, which isisnt true, He knew I wasnt working and had no income yet he still continues to want to support me. Can he sue me, and from a state to another stae, Do I have to get a lawyer and show?

Legally no, but morally...

You are going to get in that typical "they were gifts" and "they are loans" argument. If they were gifts or a voluntary transfer of property without consideration, then you do not owe him for this property legally.

Morally though, it does appear that you are using him a bit. The court will not like this. The credit cards are particularly a problem. I am not too knowledge about this part, but I suspect that you will pay 1/2 of the credit card bills if he used them too, while the other property will be seen as gifts where you will not own their return.

Do you need a lawyer?
In small claims, normally not. If he gets one, get one. If he doesn't, it is up to you. Personally, I would only get an attorney involved if he did. From the sounds of it, I wouldn't be surprised if the maximum was exceeded for a small claims court...

From which state...
If he lived in MI during this time, then more than likely MI. He could file in Fla though, but it would be a mistake on his part.
