i live in Atlanta Georgia and my two sons father lives in
Washington dc. we were never married and now he is married and has another baby on the way(3kids). i want to take him to court for child support and etc. i know that all i have to do is to get him to do a Aff. of Parentage since he is not denying the kids and he is on both of the B/C. when i go to court for the judge to sign the Aff. of Parentage can he do child support payments and custody right then and if not how do i go about doing that????? sorry because he is in the army how can i get him down here(Georgia) to do the Aff. of Parentage?????? and since he is legally married when they do the child support payments do they go by her income too?????

The judge would only be able to order custody/visitation/support once the father acknowledges paternity, and support can only be granted after a hearing which your ex would be served notice of so he could have legal counsel or represent himself.

Usually there are two seperate hearings, the first being the paternity issue, and then another hearing at another date to determine support.

Also, the new wife's income is not taken into consideration when determining the amount of support. Only the fathers and your income.

Child support calculations are usually based on the father's and the mother's income, so that would be he and you. His new wife is not a parent of your child, is not responsible for supporting your child and will have nothing to do with the figures. If they currently have or ever in the future have children, his need to support them is usually not part of the equation either. The only thing that may be considered is if he has any children from prior relationships/marriages for whom he already pays support. The support he pays for that/those children would affect what he would pay you. Confused yet? =)
