What is the name of your state (GA)?

My ex's lawyer finally after over 2 months did the final court order, however he put in the court order alot of things the judge did not order. Like extra visits with the child and 6 weeks for the summer and so on.

Can a final court order be redone if you can prove it has a bunch of B.S in it?

Who all needs to sign a court order once its done, for ex

After his lawyer types it up, does it go straight to the judge or does my lawyer have to approve it?

Do i have to sign it before its done?

Please tell me the steps

Thanks

when does a judge normally signs it, before my lawyer can make it right, does my lawyer have any say?
Your lawyer may very possibly be able to do something about it. However, its more problematic if the judge has already signed off on it. Talk to your lawyer ASAP.

ok well its still confusing. I'll talk to my lawyer late next week once hes back, ITs just killing me now.

So a judge can sign a court order without the other lawyer approving it first? Thats kinda strange, putting so much trust a one lawyer that wanted to win for his client, but didnt.

Thanks for you help!

any other info would be great.

A judge does not normally "just sign" an order. A proposed order is usually submitted by the attorney who writes it to the other attorney for review. It may go back and forth a couple of times before the wording of an order is agreed upon. Whether or not the proposed orders are agreed upon, a motion to sign orders is filed. If there is disagreement, the motion goes to a hearing in front of the judge. The attorney's take a copy of the relevant transcripts and hash it out in front of the judge on how the wording should be. The judge may order the proposed orders rewritten and resubmitted, or may make line item corrections on the spot and sign it.

How long did your attorney have the order in his possession before it was filed? If he sat on it, it could have been submitted without him doing anything. Be prepared to pay for the transcripts from the trial (at approximately $2-4 per page).

Ok, I finally got my answer from my lawyer. Thank you for you help guys sooo much. This is what happeaned.

My ex's lawyer wrote the order Dec 22 at 5:22 pm and delivered it to the judge to sign on Dec 23rd 10:00 am and TOLD the judge both parties agrreed. The first time my lawyer ever saw the order was Dec 23 rd after it was signed.

Anyways on Dec 23 my lawyer talked to the judge in person and told of what happeaned. The judge assumed my ex's lawyer told the truth and did JUST signed the order.

THe judge did offer to abloish the order, but my lawyer told him to leave it for the time being and has order the full transcript and will revise the court order. HE should get it by Jan 5th. My lawyer wants to act professional and will send it to my ex's lawyer to review, but he assums we will be back in court with a short time but my ex and his lawyer wont change the BS court order without a fight.

Can anything be done about this ******* lawyer????:D

Believe it or not, this is something that happens far too frequently. I cannot count the number of people I have seen on forums like this, who had that happen.

Furthermore, many folks do not catch this or take any action in time for the judge to easily correct it, and the judgment stands. It can then only be changed by means of a suit for modification, which complicates these things immensely.
