Could some one please give me some advice about this friend of mine who just recently spilt up with his girlfriend and togather they have a baby girl who is 6 months old. His girlfriend is not being very understanding about visitation rights, now let me tell you he buys this baby everything her formula her clothes and all he wants is to visit with his baby at his parents house she wont bring the baby over at all please let me know his rights as a father. When they do go to court to get joint custody will he be able to keep the baby over night, from my understanding they baby is to young to keep over night is that true???

Your 'friend' needs to file for visitation with the court. In that petition he will be required to take a paternity test because he is not the 'legal' father due to the lack of marraige.

Once paternity is established, he will get visitation ordered by the court.

First of all he DOESN'T NEED A LAWYER. Have him contact the county court local Self help or pro per clinic. They can help determine what steps he needs to take. Second, any money that he is spending have him keep the receipts and records. If she does want back child support, which they always do, he will have proof that he was providing some support. She will more than likely get custody since the child is so young and he will get joint custody with her having primary custody. Child support will be determined from their NET, not gross, income and how much visitation he has. The more visitation and more income that she has the lower the child support.

personally if he WANTS joint custody, EXCELLENT visitation rights etc.., he will beg borrow and steal to have a lawyer represent him.
