A while ago, I was a server at a restaurant in Texas. It was apparent that I was one of their best servers and have been acknowledged of that by the GM and two other managers. There was one manager that didn't like me though because I didn't laugh at his jokes and he seemed really serious to everybody all the time when he wasn't trying to joke around. One by one over the two weeks, many servers and bartenders quit without notice or even walked out. Those that were new and couldn't handle it just wrote a note stating their resignation and the mangers didn't seem to care about that. Anyways I was dealing with problems of my own since I was on medication and the managers there made me close almost all the nights I worked since I was one of their stronger servers. This was taking a toll on me as I had to hold off the medication so I didn't fall asleep. If I didn't take it in time, then I shake, throw up, and my body would refuse to sleep. It was suppose to be for Tourrettes but it did not help at all.
After about two months of going through like this, I put in my two weeks, then two days later, I just told one of the managers that I wasn't going to show up anymore because of limited finances at the establishment. The last day I worked though, I made around $20 that would be sent through the check. When I came in to pick up my check, I received the check from before that last day as the credit card tips are processed in the check and are made the week before. I have yet to collect the check with the $20 because the manager that I stated that didn't like me told me all staff that quit without a two weeks are banned for 90 days. There was no paper agreement to this though and it was not in the employee handbook.
Around an month and a half later, I was going through a detox with the medication I was on since it was making me suffer and I didn't want to take it anymore. My friend asked my GM to allow me to come in for a service they had and allowed it. The manager that disliked me though blew up at her and threatened to write her up. One thing I forgot to mention is that people that quit without the notice were not given the ultimatum by the other managers and continued to eat there as guests afterwards. Anyways I went there and left afterwards, then at another restaurant I was told by one of the staff there that when the manager that disliked me mentioned me, he stated that if he was 10 years younger that he would assault me.
After the 90 days were up, I came back to eat. A staff member informed the same manager and he stated to the server that I was banned for life because he needed me to close on my last two weeks. I left then filed a Workforce Commission packet citing several instances of the manager's wrongdoing, such as inappropriate relations with the opposite sex such as showering them with gifts and jokes of the type, basically filing a discrimination complaint due to sex. I also filed a complaint and made several calls to the commission as my last check was not sent to me. I also sent an e-mail through the restaurant's website about the issue and was not sent a reply. After several weeks, I was told by the Texas Workforce Commission that there wasn't anything they could do. Since I sent the complaints, the managerial staff panicked and started to enforce the 90 day ban rule on everyone. The same manager that dislikes me is still doing his same routine though as several staff members commented to me that he choked a female staff member in a joking manner and several guests questioned the act. They also complain of him making the workplace a hostile environment. Since I have quit, the Commission said there wasn't anything I could do.
One last resort that I have had on them is that the restaurant serves under aged people. Reporting the restaurant to the TABC is my last resort. Anyways I'm still mad at this at the principle of the matter and I ask is there anything I can do to get myself unbanned? I haven't made a ruckus and it seems as though the ban is an extreme arbitrary issue. This might not matter anyways since I'll be going the military early next month and come back a year later, but is there really anything I can do about this>
