Here's the situation. My neighbor lets his one dog sleep outside at night. The problem is that it's barking in the middle of the night wakes me up. I've approached him about it and he said that he doesn't hear it. I've also asked the other neighbors about it and none of the hear it. My landlord thought I might be dreaming about it and then suggested that I tape it. I've managed to get it once going off at 4am. The problem is that by the time I come to my senses and grab my camcorder, and hit the record button, the dog has stopped barking.
I've called the police and all they can do issue him warnings because they don't hear the dog bark when they arrive. I've also complained to my neighbors landlord. She just says "I'll call him and let him know the neighbors are complaining about your dog barking at night."
Now could I file a motion in civil court and request some kind of legal injunction to force him to keep his dog inside the house between 10:30pm and 6am? Is this possible? How would I argue this before a judge?
