What is the name of your state (only U.S. law)? Arizona

A Neighbor's tree is damaging a shared fence? We talked about his making repairs after the hot summer was over. However, when I spoke to him recently he stated he probably would be foreclosed on within 90 days and would not be fixing the problem.

Do I have any options to make any future real estate agents or purchasers aware that they will be respobsible for fixing this known condition? What is the name of your state (only U.S. law)?

Sue the bad person in court.

If it is foreclosed and there's a real estate sign in the yard, have your lawyer write the agent a letter tell him about the condition.
