I reside in Wa. State and two years ago, I was rear-ended by a loaded Semi-truck resulting in injury to my back requiring surgery that was unsucessful. My attorney has sent a demand for settlement and the other ins company has only offered 125000.00 and indicated that was the final offer which barely covers my costs. My question is, what do feel is a reasonable settlement amount for this type of injury. I had a microdiskectomy and two years later there is no real change. I would like to ask what sounds like a fair and reasonable settlement for this kind of a case? I will gladly provide more details if desired.

My attorney told me that he felt that we were probably in the 250,000 range, although it is possible that it could go a bit higher. From what I've been able to gather from other verdicts I have looked at, I feel it should go somewhere around a half million, maybe more since I have permanent injury from it. I continue to work but I feel like Im limited in how much longer I will be able to. I'm just basically looking for opinions on what a case like mine should be worth......

Unfortunately, you probably won't get too many responses. This forum seems more geared towards specific answers to specific questions, rather than generalized conclusions regarding expansive situations.

Really the only thing in your post on which to base an answer is that you had an unsuccessful microdiskectomy two years ago. You could imagine that any answer based on that would be meaningless.
It would be kind of like the question "How much does a 2 year old red car cost?"

If you make it short enough that people will read it, you can't get a meaningful answer, but if you include enough detail to get a meaningful reponse, the post would be so long that no one would read it! Kind of between a rock and a hard spot here.
