I live in PA. My mother is going through a divorce. They were married for 12 years. Second marriage for both of them. During this time my mother never worked except at the beginning when she held a part time job answering phones for an answering service for miniumum wage. During the begining of their marriage, her husband found a really good job and things were going great. Then my grandmother fell ill and she gave my mom her property and 10,000 as a down payment on a doublewide with the intent that she could live with them until she died, and she did. Then, my mother and her husband decided that they wanted a larger place and they had a foundation built and put a huge double wide on it. He was making almost 75,000 a year by now and the payments were a breeze. Then he decided he wanted a divorce and stopped making payments on the house. He stopped working overtime and took a lower paying job in the company. He drained the savings to make payments on the house. Then stopped making the payments all together. Then he told her, while she was in the hospital having her 5th operation, that he found some one else and that he wanted a divorce. He then tried to get a loan out of his 401k to catch up the payments on the house, so she would get less of his 401k in the divorce. He has told her now that he took the lower paying job so that she would not get as much support. The house now has gone up for sale. A buyer was found and they made an offer for 10,000 less than is owed to the banks. The offer would be a good one if there wasn't so much interest owed from the payments that he refused to make. She has copies of the returned checks where he blew the money at the clubs. Her husband accepted the offer, but she refused it. Now the banks are calling her, and today they threatened her, trying to get her to sign the papers. She has nothing. She is living with me and my family. She recieves 900.00 a month in support. Her attorney is going to try to get her medical benefits after the divorce and alimony.
Now my questions are:
1. Is there any way that she can be held resposible for the mortgage?
2. Is there any way that she can get back the value of her mothers property?
3. Can she get him on something like breech of contract?
4. There is a credit card with her name on it that was used for finishing the game room in that house. Is she responsible for it? It is in her name and he had a card of his own on this account. Should he be paying for it since he was the bread winner of the family?
