Just to get my unsolicited two bits in on that spicy little discussion...

and not to disagree with IAAL, because I DON'T, but merely to add that NOT ALL creditors are big, institutional creditors for whom getting screwed by deadbeat bankruptcies is just a cost of doing business...

SOME OF US ARE LITTLE, Po' FOLK without the money to hire attorneys to defend us agains the BEND OVER of cockroach, lyin' ass, deadbeat DEBTORS trying to SCREW US OUT OF WHAT WE RIGHTFULLY OWN OR ARE ENTITLED TO!!!

Not that this applies to you, Lawyerless, because I truly don't know, but I'm pretty tired of the prevailing attitude that the debtor is somehow the VICTIM, and I do have to say, that as nice an idea as it is to stay at home with Jr., I'd prefer you don't do it on MY dime, figuratively speaking...

Also, FWIW, you might wanna take the long view, sister... do you really want to do this to your credit, especially now that you have a young 'un to provide for, plan for, save for? Tighten the belt, get a part-time job after Daddy gets home, and pay down the debt... don't BK your credit for a measly 15K. You can work that off honestly in no time ... certainly in less than the three years it would take to pay it off in a plan at pennies on the dollar, harming both your creditors and you.
Check out some of the stories on here from people who REALLLLY need the protection. See if your situation honestly compares or if you're going for the quick out....Dignity counts, sister, keep yours.

My response--

The po' sniveling, cracker-ass bullsh-t peddlars whose previous string got locked before I got my two bits in, that's who.


So this lawyer gets up in the BK court Thursday and admits that his client doesn't have a job, has never had a job, but she's filing 13 on her own, without her husband, because she's the one who shopped up all the debt.

And the judge wants to know how the hell she qualifies for Ch. 13, since she doesn't have regular income, and the lawyer says the husband will fund the plan, that the husband will even give her a salary for her spousal duties, just to keep her spending under the control of the Trustee. The judge isn't buying it.

So the lawyer says, "Judge, this case is like the guy whose charge card gets stolen and he doesn't report it for a year and a half, and the company asks what the hell took him so long, and he says, 'Well, the guy who stole it was spending less than my wife.'"
