Acceptance of Terms of Agreement

Many websites and software have a terms of agreement, or conditions of use section on the website, or during the installation of the software.

Before software can be installed, you must click a checkbox that says you have read the agreement.

Some websites will have a checkbox, and others will just have a note saying "by placing this order you agree to the terms associated with this website"

I ran across a website that uses a similar method to have their customers agree to the terms and conditions of the website. However, the line that says "you must agree to these terms" comes after the line that allows you to place your order!

Basically, the page displays all of the order information, and then it has a very large Submit Order button, then it has a line of text BELOW the Submit Order button, that says you have to agree to the terms and conditions.

Does the agreement hold true?

If so, that means that I could have an item listed for $100, and then at the bottom of the order page (below the button to submit the order), I can say "by submitting the order, you allow us to charge you a $100 additional service fee per item on top of the order total above, there will be no refunds, cancellations, nor returns"

Please keep your questions in one thread. Trying to find another way to call the kettle black is not going to work. Face it, you were legally screwed over and have no recourse. Get on with your life.

There is no reason that the terms need to be "above" the submit button. If they tell you that by pressing the submit button you agree to certain terms, that should be a red flag to you to make sure you've read and understood the terms of what you are agreeing to BEFORE pressing the button...
 
So this assumes that everyone has to read the full page before submitting the order. Even if you reach the submit order button, and the page did not display any type of terms so far (meaning you scrolled down to submit order, but never scrolled further), you still have to abide by the terms that you did not see. Correct?

no, that is NOT correct.
