Can a father get a court order from a judge to allow him access to his child on Easter? He has been denied access to the child (1 year old) by the mother when he went to see him a couple of weeks ago. No custody papers or child support charges have been filed yet. It is all pending in the next few weeks. They were never married. A letter was sent to her lawyer by his lawyer requesting access on the childs birthday and it was denied. His lawyer said he would send a letter again requesting access for a few hours on Easter but not to count on it. I was wondering if he could get a judge to grant access. He is in Texas.No DNA has been done but he has stood up in court and said the child is his and his name is on the birth certificate. Thank you.

There is no way he will get into court before Easter.

Now, if he wants to avoid this problem in the future, he should go to the courthouse next week and file for paternity establishment (including DNA) and custody and visitation. He should expect her to file for child support when he does this.

But at least now, he will have a schedule to see his child & mom would be in contempt for denying visits.

It is POSSIBLE for a father to get a court order to see his child on Easter. However, in this case, he wouldn't be able to get a court order before THIS Easter. Unless there is a court order that gives dad the right to access to the child, mom is not doing anything LEGALLY wrong.

Thank you for your answers. Child support has been filed but the court date is a few weeks off. He was hoping to get a quick access going since the childs half brother is in town and the family wanted to spend time with him (the baby) . We had to put his birthday gifts outside the apartment door because we couldn't see him. Hopefully once it goes through the system it will straighten out.

TX for the clarification ceara :)

Sounds like OP needs to await the CS hearing...then petition to establish Custody/Visitation/transportation, etc.
