My son was hit on the highway by an un-licensed 16-year old girl (Natalie), who was no longer living with her mother because they didn't get along (for about 2 weeks). Natalie was cited for an unsafe move on the highway (and for driving without a license) and was determined to be the cause of the accident by the California Highway Patrol.
The car she was driving was owned by a lady (Lisa) where Natalie stayed for a short while. Lisa let Natalie's 18-year-old boyfriend drive the car so he could get to work, and another of Lisa's friends (Ashley, also 18 years old) was to drive the car home. But Natalie lied and had intended to drive the car back to Lisa's when they took it. Lisa specifically told Natalie she was not to drive the car before they left. It was when Natalie was driving back to Lisa's house that Natalie lost control of the car and hit my son's car.
I have about $4,000 damage to my (son's) car.
Who is liable for the damage to my car? (I do not have comprehensive coverage for my son's car, and therefore do not have un-insured motorists coverage either.)
Is is true that the Natalie's parents' liability is limited to $1,000 max because she was a minor no longer living under their roof? The separated father wants Lisa to report the car stolen to the police (since technically, Natalie did not have permission to drive the car.) And he claims if Lisa reports it as stolen, he will write us both checks for the damage to our cars. He claims he wants to teach Natalie a lesson because she is taking the whole situation too lightly.
We are lucky we are talking about damage to cars and not to people. Fortunately, no one was hurt.
I just want my car paid for and don't know what to do. I don't want to report it to my insurance company since they won't pay anything anyway.
