just spoke to my lawyer. proceeding with deposition soon for a car accident. there is definately bad faith insurance practices going on. my lawyer said the other side would be less likely to settle out of court if i ammended my suit to included the bad faith, is this true? i want to punish the insurance company so that they do not do this to someone else. she said she would add it if i wanted, should i? here in canada the government is already investigating insurance companies for "being in bed with the independant medical examiners". i have had the causation part covered since almost the beginning and they still refuse to pay benefits because of one of these "independant examiners" i know my lawyer does work for both sides of the fence in litigation depending on who hires her. should i hold off with the ammendment? thanks for the advice in advance.

Mustang Sally, sounds like your attorney knows what she is talking about. This kind of stuff goes on in the US also. I would recommend that you stick to the facts of the case. Including the bad faith claim will only muddy up the waters. If you have a multi-million dollar claim, then throw the book at them, otherwise try to settle.
