I am posting this message in hopes that someone will be able to give me some advice on what I should do about the folowing situation.
Back in November 2005, I got int oa minor accident with a Dunbar Armored truck. I was in the farthest left hand lane since I frst got on the street when the Dunbar Armored truck attempted to make a lane change and sideswipped my car. According to his version of the story, he is saying that I flashed my lights at him (which I did not) and he pulled over and I said he hit me. What really happened was he pulled in front of me after he made contact and got out of the truck and asked me if I was okay. According to his story he asked me if my car was okay and I said yes, which is not true. He then said I left first and then flashed my lights again at him to pull over. Which is not possible the way the street is set up, and besides I was behind him after he had pulled over. He was in front of me after the accident occurred. After he had this conversation with me, he got back in the truck. I thought he was going to get his information and I went to do the same when he started to drive away. I then followed him down the street and got him to pull over again.
According to the police report, I have no fault but for him, the officer put down "Other" for his fault in the accident. What exactly does that mean? Why would he put other? The insurance company of this truck is saying he has no fault at all. Is "Other" the same as "none"?
I notified the insurance commission and then the company offered me 50% once I send them an estimate. Money is tight right now and I really don't have the money to pay half of the damages, which is about 656 dollars. I fel I shouldn't have to pay a dime being that he came int omy lane when I was driving and folowing the rules of the road. I also have been trying to come up with a 500 dollar deductible to go through my insurance but it's so hard. I thought I could get the company to pay for all my damages but at this point this situation has become beyond aggravating since I seem to be going nowhere with it.
My question is this:
Should I continue to try to get the full amount in damages from this company on my own?
Should I asttempt to go to smal claims court
or Should I come up with my deductible somehow and go through my insurance? My biggest fear with this is that my rates will go up as a result of this accident because if they do, then it's not worth it (I don't think)
