My daughter was in an accident about a month ago in which a young man turned infront of her to hurry into a fast food parking lot, and he hadn't paid attention that a car was blocking the drive so he had to stop right infront of her, then of course she ended up hitting him. The state police were right there, he wasn't issued a ticket but was marked on the police report as being at fault. We only have PLPD on our truck, so all we could possibly get from their insurance co is $500.00 (it is going to cost us $3400.00 to fix it!). I just found out they told their ins. co not to pay because they didn't feel he was really at fault. I'm planning on taking them to Small Claim court. My question is, can I sue them for the entire $3000.00 since the ins co is out of the picture now or do I have to settle for the $500.00 & costs? I live in Michigan.
