What is the name of your state? FLorida

I accidentally bought land on EBAY. I entered a bid for $501.00 for 40 acres . The auction ended and I was the highest bidder. When I went to check the terms of the auction..this $501.00 was just a downpayment on land that costs $19,999.00 I was in shock when I realized what I have done.


Can I get out of this? What are my rights?? Please advise.

I have tried to retract my bid..but it was too late.

you may have to just appeal to the goodwill of the seller, the responsibility was on you to research what you were bidding on, expect negative feedback, they may let you out of the deal if the next highest bidder takes them up on a second chance offer, but they are under no obligation to do so...this may be a very expensive lesson

I have a feeling you are correct. I may have to rely on the kindness of the seller. Doesn't the seller and the buyer have to have a "meeting of the minds" for a contract to be legal. There was definately not a meeting of the minds.

yes, normally. however for all intents and purposes you did have a meeting of the minds, all over ebay it says "read the item description" your bid is a legal contract", make surre you know what you are purchasing"

by making that bid you are kind of acknowledging that you are aware of the item being sold and at what terms...

$501 for 40 acres?? :eek: That lil bell in your head should have said this was to good to be true and it might be wise to read the whole auction. I say bow down to the all mighty seller and kiss some a**.

19K for 40 ac in FL may not be a bad thing unless it is at the bottom of a lake, is this the same as the land you bought by accident in NV on your other thread? There is no reason to start 2 threads.

40 acres is in Nevada, Not Florida

The 40 acres I am refering to is located in Nevada. I reside in Florida/

The 40 acres is very undeveloped and may not even have electricity and other services available/

I entered the thread twice. Once in consumer affairs for online problems and another thread in the real estate section. At least...thats what I thought I did.

Post a link to the auction, it will be up for 30 days after the auction ends. Seeing what is actually listed will help us give a better answer.

I just read EBAY policies. Real Estate is the only thing were it is non-binding. I AM OFF THE HOOK

I've seen those auctions. Some are clear about the bid being for a deposit or down payment, and some go to great lengths to hide it. You already found out that you don't have to honor your bid, but in the future be sure you read evry line of those auctions.

BTW: where is the land and what is the legal description? 40 acres for 20K might be worth some good bucks someday.....or might be BLM or military reserve land that can't be sold.

Location of land

Hi,

The location of the land is outside of Winnemucca, Nevada. I do not think there are any roads or utilities at this location, not yet...atleast.

There is supposed to be major gold deposits in the area.

Well, there is gold and many other minerals all over Nevada, but getting enough of it out of the ground to actually make any money/profit can be very expensive. If there was a significant amount the major players like Barrick would have had it mined out long ago. If it is land that can be developed into some kind of residential or commercial retreat you could have something of value. Of course, it would need its own source of water, and then access to power. Keep in mind that Winnemucca is very cold and harsh in the winter.

How far off the main highways is the piece?

If I were you I would take the bid and figure out a way to get financing!

We purchased 40 acres here in AZ, it's about 1 hour North of Lake Havasu, at the base of the Halipua Mountains ....

4 years ago paid 24K for it.

It's now reselling around 38,000 - with NO utilities.

Nice investment.. find a way to keep the land!
