What is the name of your state?What is the name of your state? New Mexico

Is an employer in New Mexico required to pay for accrued vacation time at termination, whether voluntary or not? In the past 5 years, the company has paid vacation to all departing employees, but there is no formal agreement or policy.

I could not find any regulation in the NM statutes that require an employer to pay accrued vacation to terminating employees. The fact that they may have done so in the past may have implied a company policy, but even so, I could not find anything in the law requiring them to adhere to the company policy. You could call the NM Dept. of Labor to confirm though.
