To All,
I am working with my little sister to help her out. She has been accussed of turning in a typed homework assingment to her Physics professor that he says she copied from a solutions manual. I will quickly lay out the details of the case and ask of your advice.
My sister denies that she turned in that paper. Due to a wrist surgery and re-hab concept, she has been typing all of her assignments on the computer.
The Basic Outline Factors working against her:
- Even though she types her assigments on the computer she does not keep a saved copy of the file. She simply thinks since it is a homework assignment that she will get it back, graded, so she can review it later.
- She has no note-taking / scribble of the assignment prior to turning in the assignment
- The typed in copy of the paper that the professor showed to her saying that she plagiarised had her name typed on it suggesting that she authored the paper.
- He explained to her that even though this is assignment number 9 that he knows she has been copying her work from a solutions manual all along, from the first assignment to this one, he explains it has been a trend.

- The paper the professor showed her lacked something that she always puts on her headers underneath her name, her ss#.
- She is a very hard student and performed well throughout her high school years, and first two college years and has never onced been accused of cheating.
- She is a student athlete on scholoarship with NCAA. She knows cheating on a homework assignment means great problems.
- Even though the course material has been tough for her, she does not own a solutions manual. She has been recieving help from her tutor in the course, and her tutor does not have access to a solutions manual.
My Questions:
- Is the burden of proof on the professor or the student? Can she plead no contest in this case and let the professor have to prove his reasoning?
- Why would the professor take so long and wait so long to accuse her of plagiarism if he claims that she has been doing it all along?
- If the paper in his hand is not hers, then what happened to hers I know becomes a real interesting question. But doesn't this question deal with Motiff and is irrelevant? I thought the point of this case it to prove or disporve authenticity of the paper in the professors hand right now.
- She has been talking with the professor about the case, and he denies her the right to look at the papers again, and he keeps telling her that her excuse of she did not turn in the paper is not enough. Is their a clause that allows her the right to bring this up to a judicial review where all the evidence can be reviewed?
- How do you deny plagiarism when you are innocent?
- Can we file suit against the professor for pure harrassment because of his unwillingness to cooperate? He keeps prolonging the event and my sister's emotions are baring very thin. She is losing focus in her other classes and thinks the world is against her now.
- Proving that she did not author the paper that he has in her paper is the first key. Any suggestions?
