If one word is mentioned in an opinion forum such as "Thief" is that libel? Unless you really know the law, please don't post back to tell me how stupid you think I am. I have seen some of the replies to honest questions about legal issues and I don't think we need personal viewpoints that degrade the person posting. If someone is selling something on the internet and describes the item as being in excellent condition along with a number of other misleading statements all implying that it is in perfect working order, however slips in "As is" at the bottom, does that statement give him Cart Blanche to rip someone off? To top it off, not only does that person have my money, but told me to send it back for him to check it out. (Again giving the impression that he would make it right.) So now he has the item back and my money. Refuses to do anything; He even posted negative feedback against me which ruined my 100% positive. I did not post anything for him hoping to work it out, but only replied to what he stated about me. In my reply I mentioned a shorten version of his ebay ID which I won't mention, but it incuded the word thief in it. In other words his id is "____thief" so I simply stated the truth. "Recv'd defective item. He told me to send it back. Kept my money and item. THIEF". Now he wants to contact his lawyer for libel. I should be the one suing him. Am I guilty of libel? What do you think his lawyer would tell him? What would you do if you were me? Please legal answers only. What is the name of your state?
